Haiti - Justice : Wave of appointments, the President of the CSPJ alarmed !
In a letter addressed to the Minister of Justice and Public Security Heidi Fortuné, Me Jules Cantave, President of the Superior Council of the Judiciary (CSPJ) "pushes a cry of alarm against the wave of appointments recorded these days in the Courts and Courts of the Republic," stressing that they only "disrupt the normal functioning of the Haitian judicial system."

He suggests to the Minister of Justice to "kindly stop this judicial haemorrhage aiming the appointment of Clerks, who are not qualified for the most part, and especially those who have become new and whom you have established, of Chargés de mission."

Me remins in his letter to the Minister, that the appointments of Chargés de Mission are contrary to the organization chart of the judiciary, with reference to Articles 3, 4, 23, 35, 37, 38, 48 and 50 of the Decree of the 22 August 1995 on the judicial organization.

Also he reminds him "[...] besides being a judicious Magistrate, you are not unaware that Article 45 of the Act of 27 November 2017 on the statute of the Judiciary prevents a lawyer regularly registered to the Bar of a jurisdiction to accede to the position of Judge or Officer of the Public Ministry in the same jurisdiction," deploring that "[...] unfortunately it is found that the cascading appointments in the various Prosecutor's Offices of the Republic do not respect this legal requirement."

Concluding "With all these considerations, the Superior Council of the Judiciary urges you to remain in the standards by making appointments in strict accordance with the legal provisions in force."
