HARRISBURG, Pa. (WHTM) — A Pennsylvania State Representative has announced plans to limit employers’ use of “Use it or Lose it” paid-time off policies.

Under these kinds of policies, the memorandum posted Tuesday, April 16 explains, employees who do not use earned time off in a certain period of time are prevented from carrying it over or cashing it out.

According to the bill’s sponsor, State Rep. Mary Jo Daley (D-Montgomery) the legislation will be similar to laws passed in several other states including California, where earned vacation time is considered wages.

Under that law, earned or accrued vacation must be paid to an employee, even upon termination of employment, unless otherwise agreed upon under a collective bargaining agreement.

“While it may seem easy to those in some professions to just encourage workers to use their vacation and other paid time off, many employees are denied the use of leave multiple times by their supervisors,” said Daley. “In relation, some employers place limitations on when and how vacation time is used.
